Draft for legal review — not effective terms

This original draft must be completed and approved by MyCaseCare’s legal counsel before launch. Company-specific commitments and policies remain to be confirmed.

1. Scope and agreements

These draft terms describe proposed conditions for the MyCaseCare website and service. The legal entity operating MyCaseCare, its address, and the order of precedence between these terms and signed customer agreements must be confirmed before these terms take effect. Access to paid services, selected features, and support should be described in the customer’s signed order or subscription agreement.

2. Authorized use

Access is intended for authorized firms, their staff, and participating clients. Users must provide accurate account information, protect their credentials, and use the service only for activities they are permitted to carry out. Attempts to access other users’ records, disrupt the service, distribute malicious content, or violate others’ rights are prohibited.

3. Client information and professional responsibilities

Firms remain responsible for their professional decisions, permissions to handle client information, and communications with clients. MyCaseCare is a documentation and engagement tool; it does not provide legal or medical advice, replace professional judgment, or guarantee case outcomes. Client entries may be incomplete or inaccurate and should be reviewed in context.

4. Data ownership, privacy, and confidentiality

Customer and client information should remain subject to the rights of its lawful owners. Any permission granted to MyCaseCare to process that information must be limited to the purposes stated in the final customer agreement and Privacy Policy. Before launch, specify storage, subprocessors, retention, deletion, export, confidentiality duties, and incident handling. MyCaseCare focuses on security, is HIPAA compliant, and has built the platform with attorney–client privilege in mind. Final contractual obligations should reflect the approved policies and actual service.

5. Communications and consent

Firms must obtain any permissions required for communications facilitated through the service. Final terms must distinguish operational messages from marketing communications and document the relevant consent, preference, and opt-out mechanisms. Do not enable messaging until the applicable consent process and service behavior are confirmed.

6. Third-party services and connections

Third-party services remain governed by their own terms. Any direct connection, transfer of information, or automated integration must be specifically confirmed and authorized. The presence of a software name on the website does not establish a working integration or an endorsement by that provider.

7. Subscription, fees, and cancellation

The final customer agreement must identify the plan, fees, billing timing, taxes, renewal method, cancellation process, and refund policy. This draft establishes no price, minimum commitment, automatic renewal, or refund entitlement. The Insight, Complete, and Signature descriptions are subject to the features expressly included in the signed agreement.

8. Availability, support, and changes

Support and onboarding should follow the selected plan and final agreement. Maintenance, interruptions, and changes may affect service access. Any uptime commitment, service credit, response time, or data-recovery commitment must be expressly defined in the final agreement; none is promised by this draft.

9. Intellectual property

Rights in the MyCaseCare software, website, and brand remain with their respective owners. Customers retain rights in their own materials. Final terms should define the limited access license and any authorization to display firm branding. Customer names, logos, or testimonials should not be used publicly without appropriate permission.

10. Suspension and termination

Final terms must identify grounds for restricting access, required notice, any opportunity to resolve a breach, and the effect of cancellation or termination. Specify how customers can retrieve records and when retained data is deleted. These procedures must reflect the actual service.

11. Warranties, liability, and disputes

Counsel must determine appropriate warranties, disclaimers, liability limits, indemnities, dispute procedures, and governing law for the operating entity and customer agreements. This draft does not establish a liability cap, mandatory arbitration, waiver of rights, or jurisdiction.

12. Contact and effective date

Insert the verified legal entity name, business address, and support and legal contact details before adoption. Add an effective date only after the final document is approved. This preview draft was prepared October 9, 2026, and is not an operative customer contract.
